Competition Appeal Court ("CAC")

Although the CAC rejected Clover’s appeal and review on 19 September 2008, the reasons for these rulings are not available yet.

Upon legal advice Clover has decided to formally apply for leave to appeal to the Supreme Court of Appeal against the CAC’s rulings. The grounds of appeal will be finalised once the CAC’s reasons become available.

APPÈLHOF VIR MEDEDINGING (“AM”)

Hoewel die AM Clover se appèl en hersiening op 19 September 2008 van die hand gewys het, is die redes vir hierdie beslissings nog nie beskikbaar nie.

Op grond van regsadvies het Clover besluit om formeel aansoek te doen om verlof om na die Hoogste Hof van Appèl te appelleer teen die AM se beslissings. Die gronde van appèl sal gefinaliseer word sodra die AM se redes beskikbaar word.

As previously advised, the Competition Commission has referred certain complaints against seven dairy processors, including Clover, to the Competition Tribunal for determination. One processor, Lancewood (Pty) Ltd, has reached a settlement with the Commission.
