• In these rules we refer to Clover Waters (Pty) Ltd as “the promoter(s)”, or “us” or “we”. We will refer to participants and winners as “you”.

Qualifying participants are eligible to enter this competition and will automatically be entered into the relevant draw for the Grand Prize by simply participating as follows:

How the Shopping Rules work

In order to Shop and stand a chance to exchange your Manhattan Dollars for instant prizes the following will apply:

• In order to earn virtual ‘Manhattan Dollars’, participants must purchase either the 500ml or 1.5l Clover Manhattan Ice Tea promotional packs in-store, and look for the unique code under the promotional label of the 500ml and 1.5l bottles.

• Clover Manhattan Ice Tea 500ml = 20 virtual ‘Manhattan Dollars’

• Clover Manhattan Ice Tea 1.5l = 30 virtual ‘Manhattan Dollars’

• ‘Manhattan Dollars’ are an online currency only, and are not transferable for cash. Virtual ‘Manhattan Dollars’ will be used to claim prizes on the promotional website / mobisite and to gain entry into the grand prize.

• The competition website/mobisite ‘SHOP’ will be closed from 1 September 2016 to 20 November 2016, this time is allocated to earning virtual ‘Manhattan Dollars’. The ‘SHOP’ will be open from Monday, 21 November 2016 to Friday, 25 November 2016, excluding weekends, for two hours a day between 12h00 – 14h00. This period is where participants can stand a chance to exchange their virtual ‘Manhattan Dollars’ for one or more prizes. There will be 60 physical prizes as well as 1000 instant prizes which participants will be able to stand a chance to claim over the 5-day period mentioned above. This will work on a first-come first-served basis. There are a limited number prizes to be claimed daily and they will be dispensed at 15 minute intervals over the 2-hour period each day that the shop is open.

• Participants must log on to the promotional website / mobisite (www.shoplikeanewyorker.co.za) and follow the instructions to register, create a profile and enter their unique code. Alternatively this can be done via SMS by SMSing the word ‘SHOP’ followed by the unique code on the back of this label to 32694. SMS cost R1.00. With each purchase, participants will earn virtual ‘Manhattan Dollars’ which will allow them to build up their virtual ‘Manhattan Dollars’ bank account and stand a chance to claim prizes on the promotional website / mobisite and earn entries to the grand prize.

• By registering the user agrees that the details they provided are correct and are their own.

• Codes submitted and thus virtual ‘Manhattan Dollars’ earned via SMS will be directly linked to the cell phone number that the codes were sent from. This implies that when the participant goes to register on the website the participant needs to provide the same cell phone number that they used to SMS the codes in order to access the virtual ‘Manhattan Dollars’ earned via SMS.

• Under no circumstances will virtual ‘Manhattan Dollars’ be transferred between different accounts so users need to make sure that they register with the correct cell phone number.

• Participants can also earn once-off virtual ‘Manhattan Dollars’ in the following ways; each of these will give the participant M$5.

• Registering on the campaign website;
• Completing your profile on the campaign website; or
• Sharing the campaign on Facebook or Twitter

• For every M$75 you earn, you will automatically receive an entry for the Grand Prize draw.

• Any virtual ‘Manhattan Dollar’ dollars left over after the shop closes at 14h00 on 25 November 2016 will be converted into additional entries for the Grand Prize draw.

How to stand a chance to start Shopping like a New Yorker:

• A logged in user selects ‘Shop Now’ (this link will only be visible to logged in users).
• The user is presented with the map view of the three shopping ‘streets’.
• The user selects the street where they wish to shop.
• The user is presented with the stores available in the street where they selected.
• The user selects a store.
• The user is presented with the prizes available for that store (only in stock products will be listed).
• The user browses and selects a prize to add to their cart.
• The system checks if the user has sufficient budget to purchase the selected prize.
• If not the system presents and insufficient budget error.
• The system checks if the user already has a prize in their cart.
• If the user already has a prize in their cart the system offers them the option of replacing the contents of their cart with the newly selected prize.
• The system adds the prize to the cart, and marks the prize as reserved in the database and is thus unavailable to other users.
• The system starts a 5 minute countdown. If the user has not checked out completed their transaction by the time the countdown reaches zero, the prize is removed from the cart and is once again available to other users.
• When the user is done shopping they select to view their cart.
• The user selects to view their cart.
• The system presents the user’s shopping cart.
• The user selects checkout.
• If the prize selected is of the type ‘physical item’’ (i.e. a prize that will need to be delivered to the consumer) the system present the user’s shipping details.
• The user updates or completes their shipping details and submits.
• The system request the user to confirm their purchase.
• The user confirms their purchase.
• The system sends the user a purchase confirmation email; and
• The system sends a purchase notification to Incentiv informing them of the new purchase

• GRAND PRIZE ENTRY

In order to gain an entry into the draw for the Grand Prize a Participants must accumulate 75 ‘Dollars’ in order to gain one entry into the grand prize lucky draw. Participants will receive additional entries for every 75 ‘Manhattan Dollars’ they collect. (Example: M$300 = 4 entries to the grand prize). After the shops close on 25 November 2016, any ‘Dollars’ left over will be converted into additional grand prize entries (example: M$225 = 3 additional entries into the grand prize).

Please Note:

• Your access to the website, internet speed and browsing experience can be influenced by various factors, including but not limited to, outdated browsers, Your Internet connectivity, Your internet service provider’s capacity or down time, Your computer processing power, Your Company or personal network browsing limitations, Company or personal firewall settings, Traffic peaks on the site, and/or incorrect login details. Although the Organiser makes every effort to ensure that all participants enjoy ease of access to the website and a pleasant browsing experience, the Organiser has no influence over the aforesaid factors and does in no way guarantee the participants successful access to the website, sufficient internet speed or any other warranty of whatsoever nature in this regard.

• The instant prizes are subject to promotional availability. Participating Reward Partner venues reserve the right to vary times and offer availability (e.g. Public holidays).

Each draw will take place on the below dates:

Instant Prizes

Daily between Monday, 21 November 2016 to Friday, 25 November 2016.

Grand prize

The draw for the Grand Prize will take place on the 28 November 2016.

The promoter(s) reserve the right to extend the competition or change the draw dates. Notice of this will be posted in these rules.

Who qualifies to take part?
The competition is open to all South African residents in possession of a valid identity document.

The following persons may only take part under these circumstances:
Any participant who are under the age of 18 (eighteen) (referred to as minors) are only allowed to take part in the competition and receive a prize if their parent or legal guardian gives them the required legal consent and assistance to do so. This includes assistance to take ownership of and use the Grand prize and agree to these competition terms & conditions.

All multiple entries will go into the draw for the Grand prize.

Grand Prize
The winner of the Grand Prize will be notified by telephone within 2 (two) working days after the draw date. If a representative of the promotor cannot get hold of you at the mobile or landline it has on record for you after attempting to do so at least 5 (five) times within a 72-hour period you will forfeit the Grand prize and another winner will be drawn.

Important
If a prize winner does not claim their prizes within 30 (thirty) days after they have been notified the prize winner will forfeit (give up) any right to such prize.

• The prize cannot be exchanged for cash.
• The unique voucher code can only be used once.
• The Promoters’ decision is final and no correspondence will be entered into.
• The Promoter and any of the rewards companies reserve the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
• The Promoter and any of the rewards companies reserve the right to request a copy of the till slip proving that the consumer has purchased a Manhattan product if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
• In the event that the promotional offer is not available despite the Promoter’s reasonable endeavours to procure the offer, the Promoter reserves the right to substitute the offer of equal value.
• Competition participants will not be required to take part in media, marketing and promotional appearances related to this competition. Participants however, agree that they will not be entitled to any payment for participating in this Competition, or for participating in any media format or appearances associated with this Competition if they agree to take part in such media, marketing and promotional appearances
• The participant acknowledges that in order to participate in this Competition he/she will be required to submit personal information to the promotor on the official Competition platforms only and specifically consents to the use of his/her information for purposes of the Competition only.

Important:
The promotor will not solicit personal information from participants via SMS or email at any given time for the duration of this Competition. Participants are responsible to take the necessary precaution when receiving unsolicited SMS’s or emails. The promotor will not be responsible for any liability due to the divulging of personal information in response to unsolicited SMS’s or emails

• You agree to indemnify the promoter(s) fully for any loss or damage the promoter(s) may suffer because you breached the competition rules.

• Under this entire clause “indemnify” means you agree to reimburse the promoter(s) for the following: any loss or damage they suffer, any expenses and costs they paid or are responsible for. Legal costs means costs on an attorney and own client scale.

• You also agree to indemnify the promoter(s) for any loss or damage you suffered because you took part in this competition or used the prize. If you enter the competition, or use or accept the prize, you understand that you do so of your own free will. This means that you cannot hold the promoter(s) legally responsible for any loss or damage or legal expenses you suffered because you took part in this competition or used the prize.

• You furthermore agree to indemnify the promoter(s) fully for any loss, damage, claim, or injury that may occur because of the use of the prize or your inablity to use the prize for any reason. This includes, but is not limited to, injury, loss, death or financial damages caused to any person other than yourself.

• You furthermore agree to indemnify the promoter(s) fully for any loss, damage, claim, or injury that may occur because you divulged your personal information in response to a unsolicited sms or email.
• You therefore agree that you cannot hold the promoter(s) legally responsible for any loss or damage or legal expenses or medical expenses you suffered caused because you used the prize.

• You will protect the promoter(s) from being held legally responsible for the loss or damage or legal expenses of another person (legal or natural) if such loss or damage or expense was incurred because:
• you breached the competition rules;
•  you took part in this competition; and/or
• you or any person used a prize.
