terms and conditions
Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1. The rugby experience competition (Competition) is being run by Clover S.A. Proprietary Limited, Registration Number 1994/001064/07 (Organiser/we/us/our).
1.2. Each person entering the Competition (participants/entrants/you/your) and/or accepting any prize in terms of the Competition, agrees and accepts that the Competition rules as set out in these terms and conditions, as amended from time to time (Rules) are binding on him or her.
1.3. The Competition consists of persons purchasing the participating products and submitting entries using the barcodes of the products.
1.4. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
1.5. Participation in the Competition constitutes acceptance of these Rules and participants agree to abide by these Rules.
1.6. The Organiser in no way is and should not be considered by any person as an official sponsor of the events to which the prize is available nor any team involved.
1.7. Copies of these Rules are available online at www.clover.co.za (Website) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Competition shall commence on 12 May 2023, at 00h00 and will end on 31 July 2023, at 23h59 (Competition Period).
2.2. No entries received after the end of the Competition Period will be considered
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must:
3.1.1. be a legal, permanent resident and/or legal citizen of the Republic of South Africa (South Africa);
3.1.2. be in possession of a valid identity document with a 13-digit identity number or valid permanent residency permit document with a valid permanent residency permit number;
3.1.3. be 18 years old or older on the date you enter;
3.1.4. have a valid passport and VISA, which shall remain valid and comply with any and all requirements to enable the lawful travel of the participant out of South Africa and to the relevant destination countries
3.1.5. not be barred from (a) traveling to relevant destination countries and/or (b) from or to any airline, accommodation or activity or destination applicable to the Competition. Any travel requirements may include any mandatory vaccination and/or other requirements of any competent authority in South Africa and/or the relevant destination countries; and
3.1.6. be available to travel to and to participate in the prize won during the Competition from and until all relevant dates applicable . The dates provided at any time being only the anticipated dates and the Organiser may, in its sole and absolute discretion, change the said dates and locations;
3.1.7. be a natural person; and
3.1.8. not be barred or disqualified by any authority from participating in the Competition and/or taking delivery and transfer of the prize(s) or any portion thereof available to be won during the Competition
3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1. you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2. you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3. you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. To participate in this Competition, participants must buy any participating Clover product (being all Clover products, save for the Nestle Milo and Nestle Pure Life products manufactured by/on behalf of Clover under licence by the relevant Nestle entity) at any participating retailer (Product).
4.2. Once a Product is purchased, retain your proof of purchase of the Product and dial *120*560# and follow the onscreen prompts.
4.3. There are no restrictions on the number of times you may enter during the Competition Period, provided that it is one entry per Product purchased and participants must complete the competition entry and enter a new barcode for each entry.
4.4. No automated entries will be allowed. Entries must be made manually by a natural person.
4.5. If your entry is submitted in a manner that in the sole discretion of the Organiser will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition. The Organiser further reserves its rights, in its sole discretion, to remove any entries, posts and/or comments from any social media pages of the Organiser.
4.6. The costs of each entry will be for the account of the entrant, including standard internet costs.
4.6.1. the USSD entry mechanic costs 20c per 20 seconds;
4.6.2. USSD sessions are charged from your airtime or billing balance. Free minutes do not apply; and
4.6.3. please ensure you terminate the call when complete in order to stop the call.
5. ADDITIONAL RULES OF ENTRY
5.1. Participants must enter on a cellphone that is owned and registered to that person. No person can use another person’s cellphone for this Competition and/or entry purposes. If it is discovered that participants have entered on a phone that is not registered to them, they will be disqualified and any prize won in terms of this Competition will be forfeit (the entrant must, on demand, immediately refund and/or return to the Organiser any prize won).
5.2. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
5.3. Participants must enter their own valid South African identity number or valid permanent residency permit number when submitting an entry and this is key to all entries. No person can use another person’s identity/permit number for this Competition and/or entry purposes. If it is discovered that participants have entered an identity/permit number that is not theirs, they will be disqualified and any prize won in terms of this Competition will be forfeit (the entrant must, on demand, immediately refund and/or return to the Organiser any prize won).
5.4. All entries from disqualified participants’ mobile numbers will be rejected.
5.5. Any mobile number that enters an incorrect barcode code five times in succession will be locked out of the Competition for the entire Competition Period (Blocked Participants).
5.6. Blocked Participants have an opportunity to call the Clover Call Centre on 0860256837 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Organiser in its sole discretion, for the Blocked Participants to be allowed to enter the Competition.
6. THE PRIZE
6.1. General
6.1.1. Entrants are only eligible to win one prize per household and per person.
6.1.2. The Organiser reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
6.1.3. No participant may be allowed to win more than one of the prizes on offer.
6.2. Grand Prize
6.2.1. Entrants stand a chance to win their share of a rugby experience which includes:
6.2.1.1. two return economy flights to France from South Africa and from France back to South Africa;
6.2.1.2. accommodation for two at a hotel selected by the Organizer in France, for 1 night;
6.2.1.3. 1 of 5 double tickets (meaning a set of 2 tickets) to watch South Africa Play Scotland on 10 September 2023 live in Marseille France;
6.2.1.4. a 5 night cruise for two to Ibiza, departing from and returning to France;
6.2.1.5. all transfers from the airport in France to the relevant hotel in France, from the hotel to the game mentioned above back to the hotel, from the hotel to the French port for the cruise and from the port back to the airport in France; and
6.2.1.6. a meal, beverage and WIFI package applicable during the trip, the details of which will be confirmed by the Organizer, collectively the Trip.
6.2.2. Each winner of the grand prize must select one person to accompany them on the Trip (Guest). The Guest selected must comply with rule 3 and should the Guest not comply with this, (a) the Organizer reserves its rights to require the winner to select a new Guest or (b) the winner will forfeit the prize and the Organiser will be free to select a new winner.
6.2.3. The grand prize is limited only to the above and does not include anything not expressly listed above, for example, the grand prize does not include spending money, VISA/passport costs or any travel in South Africa (including to and from the relevant airport).
6.2.4. The Organiser reserves the right at any time, in its sole discretion, to exchange any of the prizes set out above for any other prizes of similar value.
7. DETERMINATION OF WINNERS AND HOW TO CLAIM YOUR PRIZE:
7.1. 5 qualifying Entrants will be selected as winners of the competition (Winners) will be drawn at random and the draw will take place on the following dates:
7.1.1. 3 July 2023 – 2 Winners of a set of double tickets each will be drawn; and
7.1.2. 1 August 2023 – 3 Winners of a set of double tickets each will be drawn.
7.2. At the time that a potential prize Winner is identified, the potential prize Winner will receive an SMS message on the cellphone number used to enter the Competition from a representative of the Organizer at which point he/she will be required to answer a few questions regarding his/her eligibility as well as be requested to submit documents and information, including a copy of his/her ID and passport as well as proof of purchase of the relevant Product corresponding to the winning barcode.
7.3. The potential prize Winner is not an actual Winner until his/her submission is validated and his/her documents are completed and submitted to the satisfaction of the Organizer. If a potential prize Winner does not meet the eligibility requirements, the prize will be forfeited and another entrant selected as a new potential prize Winner subject to the terms and conditions herein.
7.4. If the Organizer is unable to reach any of the potential prize Winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect cellphone numbers or inoperative cellphone numbers, such potential Winner will be disqualified and a new entrant selected as the potential prize Winner subject to the terms and conditions herein
7.5. Potential prize Winners will have 48hrs from the time of being contacted to supply any required documentation and information to the satisfaction of the Organizer.
7.6. Validated Winners will have their prizes delivered by a representative of the Organizer in a manner to be determined by the Organizer. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be forfeited and a new potential prize Winner will be selected. Winners must allow for at least 4 weeks from the time of being notified they are a Winner to receive the prize.
7.7. It is the responsibility of the Winners to provide delivery details and availability times that are accurate.
7.8. For the grand prize, it is the responsibility of the Winner to ensure they comply with all travel and accommodation requirements, including a valid passport (which sufficient pages available) and all valid VISAs. Should any travel and accommodation requirements not be met, the prize will be forfeited and the Organizer is free to select a new potential Winner.
8. GENERAL
8.1. Any taxes associated with the receipt of any prizes shall be for the account of the Winners.
8.2. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
8.3. The Organiser will interpret these Rules in its sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary in the sole and unfettered discretion of the Organiser.
8.4. The Organiser may require the Winner to complete and submit an information disclosure agreement to enable the Organiser to ensure compliance with these Rules.
8.5. Should the Winner be found, in the Organisers sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited and must immediately be returned to the Organiser on demand. Winners may also be required to sign acceptance of prizes and indemnity documents.
8.6. The Organiser reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified and any prizes will be forfeited and returned if applicable.
8.7. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize Winner.
8.8. By entering, a Participant acknowledges that personal information about the Participant will be collected, shared, stored, processed and used with/by the Organiser and their agents to the extent necessary to conduct the Competition and for communication (including the delivery of the prize), statistical and/or marketing purposes. By entering the Competition, you expressly consent to the aforesaid.
8.9. By entering this Competition, you authorize the Organiser to process the personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Clover’s privacy policy.
8.10. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Organiser.
8.11. In the event of a dispute, the decision of the Organiser will be final and binding and no correspondence and/or discussion will be entered into. in this regard and for further clarity, the Organiser shall be entitled to deal with such disputes (or any failure by participants to follow the rules) in their sole discretion, including that the Organiser shall be entitled, in addition to any other rights which the Organiser may have in terms of these Rules and/or the general competition rules, to immediately disqualify participants from the Competition.
8.12. By entering the Competition and/or accepting any prize, the entrants, users and/or Winners hereby indemnify, release and hold harmless the Organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors (Organiser Parties) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or liability of any kind resulting in whole or in part, directly or indirectly, from participation in the Competition, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
8.13. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Organiser in terms of the Consumer Protection Act, 68 of 2008 (CPA).
8.14. All Participants participate in this Competition as well as any Competition related activity and accept any prize entirely at his/her own risk. By entering the Completion and/or accepting any prize hereunder, the Participants consent to these risks.
8.15. The Organiser Parties accept and shall bear no responsibility and they will not, in any circumstances, be liable to compensate the participants, or accept any liability for: (a) any inability by the participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) or during travelling to and from same arising, directly or indirectly, out of the use of the prize.
8.16. The Organiser Parties, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize and provide no warranties or undertakings in relation to the Competition and/or any prize hereunder.
8.17. The Organiser is not liable for any technical failure that may result in an entry and/or audition not being successfully submitted and/or selected.
8.18. The Organiser reserves the right to terminate or extend the Competition at any time, with immediate effect. In the event of such termination or extension, all participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Organiser Parties.
8.19. Participants undertake to expeditiously do all things necessary to enable the Organiser to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the participant. Should any participant refuse or be unable to comply with this requirement, the participant shall be deemed to have forfeited the prize.
8.20.Notwithstanding anything to the contrary contained in these Rules, the Organiser reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize, or any aspect thereof, without notice at any time, for any reason which the Organisers deem necessary. At the end of the Competition for whatsoever reason, all of the Organisers obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
8.21. These Rules shall be governed by and interpreted according to the laws of South Africa and any participant and the Organiser consent to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng local division, Johannesburg.
8.22. Where relevant:
8.22.1. if a Winner does not accept or is deemed to not accept the prize as required herein;
8.22.2. if an entry is not valid for whatever reason;
8.22.3. if a Winner has breached these Rules and/or the related agreements/documents and/or any other applicable rules;
8.22.4. if a Winner renounces any prize and/or we deem such Winner to have renounced any prize, we reserve the right to declare the prize forfeited and/or choose a new Winner.
8.23. All Competition queries must be directed to 0860 11 75 33 between 08h00 to 16h30. Standard network rates Free minutes do not apply all costs shall be for the account of the person who made the query.
