Tropika All Stars - Guess the Island Competition
terms and conditions
Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1. Tropika Island of Treasure Guess the Island Competition (“Competition“) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) are binding on him or her.
1.3. The Competition consists of entrants guessing the destination at which the Tropika Island of Treasure Season 10 All Stars shall take place.
1.4. Copies of these Rules are available online at clover.co.za (“Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Competition commences at 09:00 on Monday 8 August 2022 and will close at 23:59 on Sunday 14 August 2022 (“Competition Period”). No entries received after the end of the Competition Period will be considered.
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must:
3.1.1. be a legal, permanent resident of the Republic of South Africa;
3.1.2 be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3 be 18 (eighteen) years old or older on the date you enter;
3.1.4 be a natural person; and
3.1.5 not be barred or disqualified by any authority from taking delivery and transfer of the Prize or any portion thereof.
3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.3. Notwithstanding clauses 3.1 and 3.2, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. The Organisers shall post Competition hints between 8 and 12 August 2022 (“Competition Posts”) on the Tropika Facebook page (https://www.facebook.com/tropikaisland), Tropika Twitter page (https://twitter.com/MyTropika), Tropika Tik Tok (https://www.tiktok.com/@mytropika) or Tropika Instagram page (https://www.instagram.com/mytropika/) (“Social Media Platforms”).
4.2. In order to enter the Competition, comment on the Competition Posts on the Social Media Platforms during the Competition Period and tell us at which tropical destination you think we are hosting Tropika Island of Treasure Season 10 All Stars using #Tropika in your comment.
4.3. Once you meet the requirements set out in clause 3 above and this clause 4, you will automatically be entered into the Competition.
4.4. There is no restriction on the number of times you may comment/enter during the Competition Period.
4.5. No automated entries will be allowed. Entries must be made manually by a natural person.
4.6. If your entry is submitted in a manner that in the sole discretion of the Organisers will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition. The Organiser further reserves its rights, in its sole discretion, to remove any Competition Posts, posts and/or comments from any social media pages of the Organiser.
4.7. All costs for the entry into the Competition, including data and standard internet costs, will be for your account
5. DETERMINATION OF PRIZES AND CONSENTS
5.1. We will select a total of 5 (five) entrants (“Winners”), across all the Social Media Platforms from all valid entries received during the Competition Period. The selection of the Winners will be by means of a random draw.
5.2. We will notify the Winners by commenting on their winning entry post within 7 (seven) days from determination of the Winners, to request copies of each Winner’s identification document and any other information as may be required by the Organisers in order to validate his/her entry and to request further contact details. Each Winner will be required to provide an electronic copy of his/her identification document and any other information required by the Organisers, to the addresses notified to the Winners, within 2 (two) days from being requested by us to do so, failing which the Winner will forfeit the Prize and have no claim against us.
5.3. If a Winner does not reply to the notification message sent by us within 2 (two) days of it being sent by us, that Winner will forfeit the Prize and will have no claim against us.
5.4. The Winners may also be announced on the Social Media Platforms and live on Expresso Show once the Winners are confirmed. By entering the Competition you (a) consent to the announcements on Social Media Platforms and the Expresso Show and (b) you consent and agree to your name, image (if applicable) and contact details being collected, used, stored and processed by the Organisers for purposes of the Competition.
6. THE PRIZE
6.1. 5 Winners will each receive a Tropika Hamper containing Tropika branded merchandise and product (“Prize”).
6.2. The Prize excludes all items not mentioned in clause 6.1 and may differ from images or items used in marketing material for the Competition.
6.3. We will contact the Winners to receive all necessary information to deliver the Prize and the Prize shall be delivered to the Winner at an address within the Republic of South Africa within 30 (thirty) business days from the date on which the Winner confirms the delivery address. Any failure by the Winners to provide all necessary information to deliver the Prize within 2 days of being requested to do so, shall forfeit the Prize.
6.4. The Prize, or any part thereof, may not be exchanged for any other item. Prizes are not transferable. We reserve the right to substitute the Prize, or part thereof, with any other prize of a similar value.
7. GENERAL TERMS
7.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
7.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary in the sole and unfettered discretion of the Organisers.
7.3. If you are not eligible to enter the Competition in terms of clause 3 above, you will forfeit any Prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time and/or the time period specified in these Rules, you will be disqualified and any Prizes will be forfeited and returned to the Organiser if applicable.
7.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
7.5. In the event of a dispute, the decision of the Organiser will be final and binding and no correspondence and/or discussion will be entered into. In this regard and for further clarity, the Organiser shall be entitled to deal with such disputes (or any failure by participants to follow these Rules) in their sole discretion, including that the Organiser shall be entitled, in addition to any other rights which the Organiser may have in terms of these Rules and/or general competition rules, to immediately disqualify participants from the Competition
7.6. By entering the Competition and/or accepting any Prize, the entrants, users and/or Winners hereby indemnify, release and hold harmless the Organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors (“Organiser Parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or liability of any kind resulting in whole or in part, directly or indirectly, from participation in the Competition, and/or the use, acceptance or possession of a Prize, and/or participation (or non-participation) in a Prize-related activity.
7.7. The Organiser reserves the right to terminate the Competition at any time with immediate effect. If this is the case, the Organiser will provide a notice on the Website. It shall be the responsibility of entrants to review such Websites in this respect. In such event, all entrants hereby waive any rights which they may have against any of the Organiser Parties and acknowledge that they will have no recourse or claim of any nature against the Organiser Parties.
7.8. The Organiser is not liable for any technical failure that may result in an entry not being successfully submitted and/or selected.
7.9. Any Prize is accepted by a Winner at his/her own risk and the Organiser is not liable, at any time, for any defect in the Prize.
7.10. Where relevant:
7.10.1. if a Winner does not accept the Prize or is deemed not to accept the Prize;
7.10.2. if an entry is not valid for whatever reason;
7.10.3. if a Winner has breached these Rules;
7.10.4. if a Winner does something that amounts to hate speech, the incitement of violence, is disparaging, discriminatory, harmful and/or unlawful and/or which, in the sole discretion of the Organiser does or may bring the Organiser Parties, Tropika, Tropika Island of Treasure Season 10 All Stars and/or the Competition into disrepute;
7.10.5. if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
7.11. In the event of a forfeiture, as contemplated herein, we shall have the right to select a different Winner.
7.12. All Competition queries should be directed to any of Tropika’s Social Media Platforms referred above.
7.13. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Organisers in terms of the Consumer Protection act, 68 of 2008.
7.14. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the organiser will provide notice of this on the Website.
