terms and conditions
Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1.1. The Tropika Island of Treasure 9 Competition is being run by Clover S.A. Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”) and consists of the following:
1.1.1 a chance to win weekly prizes (“Random Prizes”); or
1.1.2 a chance to Audition and/or to participate in TIOT 9 (“Audition/s”)
(“collectively called the Competition“).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) is binding on him or her.
1.3. A copy of the Rules are available online at www.clover.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. Random Prizes
The Competition for Random Prizes commences at 00:01 on 1 August 2019 and will close at 23:59 on 30 November 2019. No entries received after 23:59 on 30 November 2019 will be considered.
The Competition for the Audition will open at 00:01 on 1 Aug 2019 and will close at 23:59 on 31 October 2019. No audition entries received after the 31st of October at 23:59 will be considered.
(collectively called the “Competition Period”)
3. WHO CAN ENTER
3.1.1. In order to be eligible to enter and be eligible for Random Prizes you must:

188.8.131.52 be in possession of a valid identity document with a 13 (thirteen) digit identity number;
184.108.40.206 be 18 (eighteen) years old or older on the date you enter or, if you are younger than 18 (eighteen) years of age, you must be assisted to the extent necessary by a parent/legal guardian;
220.127.116.11 be a natural person; and
18.104.22.168 not be barred or disqualified by any authority from taking delivery and transfer of the Prize or any portion thereof.
3.2.1 In order to be considered for the Auditions and/or to participate in TIOT 9, you must:

188.8.131.52 be in possession of a valid identity document with a 13 (thirteen) digit identity number.

220.127.116.11 have a valid Passport, which shall remain valid for at least 6 (six) months from November 2019 and have at least 2 (two) clear pages.
18.104.22.168 not be barred from travelling to the Curacao or the United States of America or from any airline, accommodation or activity in the Curacao.
22.214.171.124 be available to travel to and to participate in TIOT 9 in the Curacao from 24 November 2019 until 14 December 2019.
3.3. Notwithstanding clause 3.1 and 3.2, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. Random Prizes
4.1.1. Purchase a promotional pack of Tropika (“the Product”);
4.1.2. Dial the USSD (Unstructured Supplementary Service Data) string:

4.1.3. Fresh products purchased will house the unique code under the product label whereas Long-Life products will house the unique code on the underside of a peel and reveal sticker.
4.1.4. You may enter the Competition as many times as you like, provided you use a unique Product code inside the pack or under the peel and reveal sticker as indicated in point 4.3 above. (i.e. One entry per Product purchased)
4.1.5. You must be able to produce a valid till slip as proof of purchasing the Product with the relevant barcode used for the entry if requested by Clover.
4.1.6. Each entry will be charged at 20c (twenty cents) per 20 (twenty) seconds. Free minutes do not apply. Cost of each entry will however not exceed R1.50 (one rand and fifty cents) in total.
4.2.1 Auditions will only be accepted on the Tropika Website, Facebook, Instagram, Twitter and Whatsapp
4.2.2 In the audition video, consumers need to tell or show us how they plan to “out smoooth” or out skill their competitors on the island.
4.2.3 The audition video should not be longer than 60 seconds.
4.2.4 Auditions submitted on Social Media will only be considered if the official Tropika page on the respective platform has been tagged and the correct hashtag, #TIOT9, was used being #TIOT9 for purposes of this 4.2, the Tropika Official Social pages are identified below:

4.2.5 By submitting your audition video on any of our Tropika Official Social pages and selecting to make yourself available to be considered for the Auditions, you consent to your name and contact details being processed by the Organisers for purposes of the TOIT 9 audition process.
4.2.6 You acknowledge that the Audition videos submitted by you for purposes of the Competition may be used by the Organisers in any manner of form whatsoever including to use such material for publicity purposes and/or to broadcast as part of TIOT 9.
4.2.7 By participating the Competition, you agree to be filmed, recorded and/or photographed and acknowledge and agree that the Organisers will own the copyright to any such material which may include your participation, free from any royalty or fee due to you. You irrevocably agree to the Organisers using, editing, broadcasting, publishing and/or exploiting your contribution in any media in perpetuity throughout the world without any royalty or fee due to you as a result thereof.
5. DETERMINATION AND DELIVERY OF RANDOM PRIZES
5.1.1 Winners will be drawn randomly from correct entries received throughout the Competition Period. Winners are therefore determined instantly on completion of their entries.
5.1.2 Entrants stand a chance to either win a share of:
188.8.131.52 R 500,000.00 (five hundred thousand rand) worth of airtime prizes (“Airtime Prizes“). The Airtime Prizes will be awarded in denominations of R5 (five rand) worth of airtime per winning entry. These Airtime prizes will be made up of 100,000 x R5 airtime prizes; or
184.108.40.206 R 190,000.00 (one hundred and ninety thousand rand) in cash (“Cash Prizes“). The Cash Prizes will be awarded in denominations of R 50 (fifty rand) per winning entry. These Cash Prizes will be made up of 3,800 x R50 cash prizes.
5.1.3. The Airtime Prizes are not transferrable from the prize winners to any other person and may not be exchanged for its cash value, except if otherwise stipulated in these Rules
5.2.1 Airtime Prizes:
220.127.116.11 Winners will receive an instant SMS notification of the value of the airtime they have won on the cellular phone number used for entering.
18.104.22.168 Airtime Prizes may be redeemed by PRE-PAID account holders of the following networks only – Vodacom / MTN / Cell C / Virgin Mobile / Telkom Mobile.
22.214.171.124 An SMS with the airtime voucher with dial-in instruction on how to redeem the airtime will be sent to the cellular phone number used to enter the Competition.
126.96.36.199 Winners with contract accounts can transfer the Airtime Prize to any other Pre-Paid number of their choice (by SMSing the winner SMS to the desired recipient), provided that Pre-Paid number is on the same network.
5.2.2 Cash Prizes:
188.8.131.52 Winners will receive an SMS containing a 10-digit PIN and will be informed to expect a secondary code which will complete the authentication process at any Absa ATM country wide.
184.108.40.206 Once both codes are in the winner’s possession, the winner must go to their nearest Absa ATM, select Cardless Transactions and follow the prompts to receive their winnings.
220.127.116.11 The account in which the winnings are stored is not a savings account and all of the available funds will be dispensed once the winners haves accurately followed the authentication process at any Absa ATM with this function nationwide.
6. AUDITIONS AND PARTICIPATION
6.1. TIOT 9 Contestants who are selected by the Organisers from the Auditions will compete with the celebrity contestant (“Celebrity“) – in Curacao for a R 1 000 000.00 (One Million Rand) cash prize during the TIOT 9, which prize will be shared on a 50/50 bases between the two persons making up the winning pair.
6.2. Determination of the TIOT 9 Contestants
6.2.1 STEP 1:
18.104.22.168 The Organisers will select at least 40 participants from the Auditions submitted on the various Tropika Official Social pages based on its sole and unfettered discretion.
22.214.171.124 The selected participants will be invited to attend a final audition and vetting process with the Celebrities and other judges in Johannesburg or in Cape Town at the Organisers’ elected dates and premises.
126.96.36.199 Participants can be called back for another audition at the organizers desired time and venue.
188.8.131.52 The Organisers shall pay all cost (flights, accommodation and transport) of the selected participants to and from the selected venue for the Auditions, excluding airport transfers.
6.2.2 STEP 2:
184.108.40.206 The Organisers will appoint a panel of judges who will, with the Celebrities, select 1 (one) person per Celebrity from the group of final participants who will be invited to participate in TIOT 9 with the Celebrity.
220.127.116.11 The final Contestants will be determined in the sole and unfettered discretion of the judges and Celebrities.
18.104.22.168 The Organisers reserve the right to select a different participant should any selected participant for any reason be unable or unwilling to attend either any TOIT 9 road show, the final audition in Johannesburg or the TIOT 9 production in Curacao, or for any reason fail for reply timeously to any such invitation and the Organisers and/or their agents shall not be liable for any claims as a result of withdrawing its invitation.
6.3. STEP 3:
6.3.1 Participation in TIOT 9
22.214.171.124 Should you be invited as a Contestant for TIOT 9, you will be provided with a Contestant Participation Agreement that will stipulate the specific terms and conditions for participation in TIOT 9. Your participation TIOT 9 will be subject to you agreeing to and signing the Participation Agreement.
126.96.36.199 TIOT 9 will be filmed from 24 November 2019 to 14 December 2019 in Curacao and the final event will be broadcast live from March 2019 on SABC 3.
7. GENERAL TERMS
7.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
7.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary in the sole and unfettered discretion of the Organisers.
7.3. If you are not eligible to enter the Competition in terms of clause 3 above, you will forfeit any prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified and any prizes will be forfeited and returned if applicable.
7.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
7.6. IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISER WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISER SHALL BE ENTITLED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISER SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISER MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION.
7.7. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISER (INCLUDING ITS SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.
7.8. THE ORGANISER RESERVES THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISER WILL PROVIDE A NOTICE ON THE WEBSITE. IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES
7.9. THE ORGANISER IS NOT LIABLE FOR ANY TECHNICAL FAILURE THAT MAY RESULT IN AN ENTRY NOT BEING SUCCESSFULLY SUBMITTED.
7.10. ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISER IS NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE.
7.11. Where relevant, if a Winner does not accept the Prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
7.12. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.
7.13. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
