Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1.1. The Tropika social media competition (“Competition”) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of the Competition, agrees and accepts that the Competition rules as set out in these terms and conditions, as amended from time to time (“Rules”) are binding on him or her.
1.3. The Competition consists of persons replying to the relevant #TropikaZero social media post in terms of clause 5.
1.4. Copies of these Rules are available online at www.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Organiser will run 1 x social media giveaway per week, over the weeks between 09h00 on Monday, 10 April 2023, and midnight on 2 July 2023 (“Competition Period”). During the Competition Period, a total of 12 giveaways will therefore be run each the Weekly Competition.
2.2. Entries for each Weekly Competition will be open for 7 days and will run on the Tropika social pages as outlined below:
2.2.1. Facebook page: https://www.facebook.com/MyTropika;
2.2.2. Twitter page: https://twitter.com/MyTropika; and
2.2.3. Instagram page: https://www.instagram.com/mytropika/,
collectively the Social Pages.
2.3. The below is a view of the Competition Period for each Weekly Competition – where the Weekly Competition will open for entries on a Monday and remain open until midnight on the Sunday that same week:
2.3.1. Week 1: 09h00 on Monday, 10 April 2023 – midnight on Sunday, 16 April 2023
2.3.2. Week 2: 09h00 on Monday, 17 April 2023 – midnight on Sunday, 23 April 2023
2.3.3. Week 3: 09h00 on Monday, 24 April 2023 – midnight on Sunday, 30 April 2023
2.3.4. Week 4: 09h00 on Monday, 1 May 2023 – midnight on Sunday, 7 May 2023
2.3.5. Week 5: 09h00 on Monday, 8 May 2023 – midnight on Sunday, 14 May 2023
2.3.6. Week 6: 09h00 on Monday, 15 May 2023 – midnight on Sunday, 21 May 2023
2.3.7. Week 7: 09h00 on Monday, 22 May 2023 – midnight on Sunday, 28 May 2023
2.3.8. Week 8: 09h00 on Monday, 29 May 2023 – midnight on Sunday, 4 June 2023;

2.3.10. Week 10: 09h00 on Monday, 12 June 2023 – midnight on Sunday, 18 June 2023;
2.3.11. Week 11: 09h00 on Monday, 19 June 2023 – midnight on Sunday, 25 June 2023; and
2.3.12. Week 12: 09h00 on Monday, 26 June 2023 – midnight on Sunday, 2 July 2023.
2.4. No entries received after the end of the Competition Periods outlined above will be considered.
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must:
3.1.1. be a legal, permanent resident of the Republic of South Africa (“South Africa”);
3.1.2. be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3. be 18 (eighteen) years old or older on the date you enter;
3.1.4. be a natural person; and
3.1.5. not be barred or disqualified by any authority from participating in the Competition and/or taking delivery and transfer of the prize(s) or any portion thereof available to be won during the Competition.
3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1. you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2. you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3. you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. Entrants will need to find the competition posts on the Social Pages each week during the relevant Competition Period and answer a question outlined in the post, where they’ll need to include #TropikaZero or #Tropika in their entry, as stipulated in each competition post.
4.2. Once you meet the requirements set out in these Rules, you will automatically be entered into the Competition.
4.3. There is no restriction on the number of times you may enter during the Competition Period.
4.4. No automated entries will be allowed. Entries must be made manually by a natural person.
4.5. If your entry is submitted in a manner that in the sole discretion of the Organiser will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition. The Organiser further reserves its rights, in its sole discretion, to remove any entries, posts and/or comments from any social media pages of the Organiser.
4.6. The costs of each entry will be for the account of the entrant, including standard internet costs.
5. DETERMINATION OF PRIZE WINNERS
5.1. We will select 1 (one) entrant from each Social Pages and will put those 3 finalists (Finalists) into a random draw to determine 1 (one) winner for that Weekly Competition. This will lead to a total of 12 winners over the Competition Period (each referred to as a Winner.
5.2. The Organisers shall select the Finalists by using an online random comment picker per Social Page and then use a random winner picker online to pick a prize winner from the Finalists..
5.3. We will notify the Winners each week by commenting on their entry post within 7 (seven) days from determination of the Winners to request copies of each Winner’s identification document in order to validate his/her entry, any other information requested and to request further contact details. Each Winner will be required to provide an electronic copy of his/her identification document and any other information requested within 2 (two) days from being requested by us to do so, failing which the Winner will forfeit the prize and have no claim against us.
5.4. If a Winner does not reply to the notification message sent by us within 2 (two) days of it being sent by us, that Winner will forfeit the prize and will have no claim against us. In the event of a forfeiture as contemplated herein, we shall have the right, but shall not be obliged, to select a different entrant on the same conditions.
5.5. The Winners may, at the sole discretion and election of the Organiser, also be announced on the Social Pages and live on the Expresso Show once the Winners are confirmed.
5.6. By entering the Competition you (a) consent to the announcements on the Social Pages and the Expresso Show and (b) you consent and agree to your name, image (if applicable) and contact details being collected, used, stored and processed by the Organisers for purposes of the Competition as well as marketing purposes in relation to Tropika.
6. THE PRIZE
6.1. Subject to clause 5, the prizes for this Competition will be R500 (five hundred rand) per week. Over the Competition Period this will equate to a total of R6000 (six thousand rand) prize money, with R500 being awarded to the selected Winner on a weekly basis.
6.2. The prize money will be deposited into the winner’s South African bank account within 4 weeks of the winner providing a copy of their South African ID and bank details.
6.3. The prize excludes all items not mentioned in clause 6.1 and may differ from images or items used in marketing material for the Competition.
6.4. The prize, or any part thereof, may not be exchanged for any other item. Prizes are not transferable. We reserve the right to substitute the prize, or part thereof, with any other prize of a similar commercial value.
6.5. Any taxes and/or costs associated with the receipt of any prize shall be for the account of the Winner.
7. GENERAL TERMS
7.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
7.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary in the sole and unfettered discretion of the Organisers.
7.3. If you are not eligible to enter the Competition in terms of these Rules, you will forfeit any Prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within the time period provided for in these Rules, you will be disqualified and any prizes will be forfeited and returned if applicable.
7.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication, marketing or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
7.5. In the event of a dispute, the decision of the Organiser will be final and binding and no correspondence and/or discussion will be entered into. In this regard and for further clarity, the Organiser shall be entitled to deal with such disputes (or any failure by participants to follow the Rules) in their sole discretion, including that the Organiser shall be entitled, in addition to any other rights which the Organiser may have in terms of these Rules and/or the general competition rules, to immediately disqualify participants from the Competition
7.6. By entering the Competition and/or accepting any Prize, the entrants, users and/or Winners hereby indemnify, release and hold harmless the Organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors (the “Organiser Parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or amount of any kind resulting in whole or in part, directly or indirectly, from participation in the Competition and/or the use, acceptance or possession of a Prize, and/or participation (or non-participation) in a Prize-related activity.
7.7. The Organiser reserves the right to terminate the Competition at any time with immediate effect. If this is the case, the Organiser will provide a notice on the Website. It shall be the responsibility of entrants to review such Website in this respect. In such event, all entrants hereby waive any rights which they may have against any of the Organiser Parties and acknowledge that they will have no recourse or claim of any nature against the Organiser Parties.
7.8. The Organiser is not liable for any technical failure that may result in an entry not being successfully submitted and/or selected.
7.9. Any Prize is accepted by a Winner at his/her own risk and the Organiser is not liable, at any time, for any defect in the Prize.
7.10.1. if a Winner does not accept the Prize or is deemed not to accept the Prize;
7.10.2. if an entry is not valid for whatever reason;
7.10.3. if a Winner has breached these Rules;
7.10.4. if a Winner does something that amounts to hate speech, the incitement of violence, is disparaging, discriminatory, harmful and/or unlawful and/or which, in the sole discretion of the Organiser does or may bring the Organiser Parties, Tropika and/or the Competition into disrepute; and/or
7.10.5. if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
7.11. Nothing in these Rules is intended to or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Organisers in terms of the Consumer Protection Act, 68 of 2008.
7.12. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
7.13. All Competition queries must be directed to 083 913 4041 between 08h00 to 16h30. Standard network rates apply. Free minutes do not apply and all costs shall be for the account of the person who made the query.
